Background
1. The Appellant filed an RTI request dt.Nil before the CPIO, BSNL,
Chennai. He stated that he had appeared for LDCE Exam conducted
for TES Group B on 15.7.07 and requested for a Xerox copy of answer
sheet of LDCE Exam of Paper I & paper II for TES GRB. The PIO,
BSNL, Chennai transferred the RTI application to CPIO, BSNL, New
Delhi on 30.7.08. The CPIO, BSNL, New Delhi replied on 15.10.08
denying information because of some clarification which they wanted
to seek from CIC. They stated that information would be furnished
after receipt of the necessary clarification. The Appellant filed his
second appeal dt.3.11.08 before the CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner,
scheduled the hearing on January 15, 2009.
3. Mr. Suresh Kumar, DGM(MIS), Mr. A. Sinha, AGM (DE) and Joginder
Singh, AGM(RTI) represented the Public Authority.
4. The Appellant’s representative was present at the hearing.
Decision
5. After listening to the arguments put forth by the Public Authority for
denial of information based on earlier decisions taken by CIC, , the
Commission directs the CPIO to provide the information to the
Appellant after payment of prescribed fees. This information to be
provided to the Appellant within 15 days of the receipt of this Order.
6. The appeal is disposed off.
