2 16.11.2011 Heard learned counsel for the petitioner and learned counsel

appearing on behalf of the State.

The petitioner is in custody since 4.7.2011 in a case registered

for the offence under Section 302/34 and 120B of the Indian Penal

Code.

It is submitted that though seven persons have been named in

the F.I.R, the petitioner is not named. His name transpired in course of

investigation on the basis of confessional statement of a co-accused

Rohit Kumar. Apart from confessional statement of Rohit Kumar, the

confessional statement of petitioner is also said to be there in the case

diary.

The learned counsel for the petitioner submits that save and

except confessional statement, there is no material in the case diary to

connect him with the allegation. The investigation is complete and

charge sheet has already been submitted against the petitioner.

Considering the facts and circumstances of the case, the

petitioner is directed to be released on bail on furnishing bail bonds of

Rs. 10,000/- (Ten Thousand only) with two sureties of the like amount

each to the satisfaction of the learned Chief Judicial Magistrate,

Begusarai in connection with Barauni (Chakia) P.S. Case No. 120 of

2011.
