In the present case, parties have arrived at a compromise.

Prabhu @ Panni, petitioner No.2 and the complainant respondent Manjit

Kaur are present in Court. They have been identified by their respective

counsels and their statements have been recorded separately.

It has been held by Hon’ble Apex Court in ‘B.S.Joshi v. State

of Haryana’ 2003 (2) RCR (Criminal) 888 and subsequently, by a Full

Bench of this Court in ‘Kulwinder Singh and others v. State of Punjab

and another’, 2007 (3) RCR (Criminal) 1052 that in case parties arrive at

a compromise, proceedings can be quashed in case of non-bailable

offence also.

In view of this, it is ordered that a demand draft worth Rs.1.75

lacs shall be deposited in the Court of Chief Judicial Magistrate, Kaithal on

8th May, 2009. Manjit Kaur shall remain present on that date in the Court of
Criminal Misc. No. 7573-M of 2006 2

Chief Judicial Magistrate, Kaithal. The draft shall be handed over to the

complainant, subject to her withdrawing the complaint (Annexure P-6).

The amount has been agreed also in lieu of proceedings pending under

Section 125 Cr.P.C. Complainant shall also withdraw all the proceedings

under Section 125 Cr.P.C. Statements of parties recorded today

separately, be read as part of this order.
