Facts
arising from the Complaint:
Mohd. Sajid had a filed a RTI application with the aforesaid
respondent on 13/09/2010. However on not having received the information within the mandated time,
the Complainant filed a complaint under Section 18 of the RTI Act with the Commission. On this basis,
the Commission issued a notice to the respondent PIO on 8/11/2010 with a direction to provide the
information to the Complainant and further sought an explanation for not furnishing the information
within the mandated time.
The Commission has received the submissions of the respondent vide letter dated
7/12/2010. It has been stated therein that the RTI application was received in their office on 15/09/2010.
It has been further stated that the information requested was under the jurisdiction of A.E.O (Physical)
and that the same was transferred to the said officer on 17/09/2010, however the concerned officer fell
ill and proceeded on medical leave. However, the information requested was provided vide letter dated
25/10/2010, a copy of the same is being sent along with this decision to the complainant.
Decision:
The Complaint is disposed off.
The PIO is hereby warned to ensure RTI applications are disposed within the thirty day time
period mandated by Law.
Notice of this decision be given free of cost to the parties.
