ORAL ORDER
Rule.
Mr. K. P. Raval, learned Additional Public Prosecutor waives
service of rule on behalf of respondent.
Learned
counsel for the applicant submitted that investigation is over and
charge-sheet is filed. The applicant is in jail since 04.10.2010.
He has no criminal antecedents.
Counsel
further pointed out that though previously, so far as the applicant
is concerned, his bail application was withdrawn after charge-sheet,
the same was as far as back on 19.01.2011. The trial has not yet
commenced. It is unlikely to be over shortly.
Considering
the submissions made as also looking to the nature of allegations
and the punishment prescribed under the law for the offences,
namely, Section 498-A & 306 of Indian Penal Code, the applicant
is ordered to be released on bail in connection with C.R.No.I-159/10
of Vadodara City Police Station on furnishing bond of Rs.10,000/-
(Rupees Ten Thousand only) with one surety of the like amount to the
satisfaction of the lower Court and on conditions that he shall :
not
take undue advantage of his liberty or abuse his liberty;
not
act in a manner injurious to the interest of the prosecution;
maintain
law and order;
mark
his presence before Vadodara City Police Station on every 1st
and 15th day of English Calender month between 11.00
a.m. and 2 p.m .
not
leave the State of Gujarat without prior permission of the Sessions
Judge concerned;
furnish
the address of his residence at the time of execution of the bond
and shall not change the residence without prior permission of this
Court;
surrender
his passport, if any, to the Lower Court immediately.
If
breach of any of the above conditions is committed, the Sessions
Judge concerned will be free to take appropriate action in the
matter.
Bail
before the Lower Court having jurisdiction to try the case.
Rule
is made absolute. Direct service is permitted.
