Heard
learned counsel for the parties.

We
are not inclined to entertain this Letters Patent Appeal. All the
same, we clarify that the directions of the learned Single Judge in
paragraph-4 of the impugned order would not come in the way of the
competent authority in examining the request of the
appellant-original respondent No.1 for varying the Town Planning
Scheme.

Learned
counsel for the appellant submits that the appellant-trust is willing
to provide alternative site for parking vehicles of the devotees and
public at large. The submission is recorded.

With
above observation, the Letters Patent Appeal as well as Civil
Application for stay stand disposed of accordingly.
