The present writ petition has been preferred for issuance of an
appropriate writ/ order/ direction or a writ in the nature of Mandamus
commanding / directing the Respondents who are sitting tight over the
application for mutation preferred by the petitioner which is in respect to a
piece of land measuring more or less 4 Kathas being Sub Plot No. 33 out
of R.S. Plot No. 96 of village Hesag, Police Station, Jagannathpur Thana
No. 247 Ranchi.

The main contention raised by the counsel for the petitioner is that
the respondents are sitting tight over it and have not taken any decision
nor have they considered the application for mutation till date. A
mandamus is sought and prayed for to dispose of the mutation
application. The counsel for the petitioner has referred to and relied upon
a decision passed by this Hon’ble Court in a similarly situated matter in
W.P.(C) No. 3926 of 2003.

The respondent No. 2 is accordingly directed to take a decision
with regard to the pending application for mutation and dispose it of in
accordance with law within a period of two months from the date of
receipt of a copy of this order.

This writ petition is accordingly allowed without any order as to
costs.
