5. 20.6.2011. Heard learned counsel for the appellant and the

learned A.P.P. for the State in respect of I.A. No.1098 of

2011,whereby the appellant, Jaiypali Yadav alias Bhasho

Yadav, has prayed for bail on the ground that injury

attributed to him in the back of the deceased was not fatal

rather the injury attributed to Jitendra Yadav was fatal.

Reliance was placed upon the post-mortem examination

report discussed in the judgment.

Considering that the appellant is described to be

one of the assailants of the deceased, presently, we are not

inclined to grant bail to the appellant. The prayer for bail of

the appellant is rejected.

I.A. No.1098 of 2011 thus stands rejected.
