The allegation is that the deceased

who was married to the son of the present

petitioner was being tortured by the present

petitioner and her husband because the

deceased was being pressurized by her family

members to bring money from her parents. It

is stated by the informant that he was

informed telephonically by the deceased on

30th of April, 2010 that she was being beaten

up by the present petitioner and her husband

and a little after having received that

information he again learnt telephonically

that she killed herself at fire.

                               The        contention           was      that        the

                    circumstances               available             from          the

                    investigation          of       the        case,         specially

paragraph-5 indicates that the deceased had

closed herself inside a room.

What appears from the rejection order

is that the deceased had a son who was born

out of the wed-lock and probably she was

carrying yet another pregnancy. There is no

specific allegation as regards the amount of

money which was allegedly demanded from the

deceased. Moreover, the present petitioner is

the mother-in-law and the husband is in

custody.

Considering the status of the present

petitioner and the fact that the husband is

in custody and it is a case under Section

304B of the IPC, let the above named

petitioner be released from custody on

furnishing bond of Rs.10,000/-(ten thousand)

with two sureties of the like amount each to

the satisfaction of Chief Judicial

Magistrate, Darbhanga in Hayaghat P.S.Case

No.40 of 2010.
