COMMON ORDER:

Pursuant
to the order passed by this Court on 05.04.2010, Mr. Shivraj J.
Kachar, Additional Mamlatdar and Mr. H.M. Shah, Assistant Geologist,
are personally present in the Court. On the basis of the
instructions received from them, Ms. Manisha Narsinghani, learned
AGP, makes a statement that the impugned orders which are
challenged in the present two petitions are recalled and the
petitioners will be given fresh opportunity of being heard within
one week from today. Learned Advocate Mr. M.B. Gandhi, appearing for
the petitioners, states that on receipt of the Notice, the
petitioners would remain present and make their submissions before
the authorities and after considering the submissions, the fresh
order would be passed in the matter. This whole exercise would be
over within one month from today.

On
the basis of the above understanding and the directions of this
Court, the impugned orders are hereby permitted to be recalled with
the direction to the parties to abide by the aforesaid understanding
as well as the directions of the Court. Since the impugned orders
are permitted to be recalled, the petitioners are permitted to
carry on their activities as they were doing earlier. Needless to
state that when the petitioners are permitted to carry on their
activities, all necessary formalities in respect thereof are
required to be observed by the parties.

Both
the petitions are accordingly disposed of in the above terms with no
order as to costs. Direct Service is permitted.
