2. 9.2.2011 The modification petition has been filed for

extending the time for filing the appeal before the

Debts Recovery Appellate Tribunal, Kolkata by a

further period of two weeks.

By order dated 24.11.2010 this Court had

directed that such an appeal should be filed within two

weeks. In the present application it is stated that the

petitioner had fallen ill and could not go to Kolkata to

file the appeal within the period directed.

On a consideration of the facts and

circumstances, the order dated 24.11.2010 passed in

CWJC No. 18977/2010 is modified to the extent that

the petitioner will file the said appeal within ten days

from today upon which the Appellate Tribunal shall

consider the same as directed by the earlier order.

The modification petition is disposed of

with the aforesaid directions.
