Heard learned counsel for the applicant and learned A.G.A. for the State as
well as perused the record.
The accused Neeraj Kumar Verma, S/o Ramesh Chandra Verma, R/o Geeta
Palli near Gas Godam, P.S. Alambagh, Lucknow, permanent address, Village
Mahmoodpur, P.ost Subhan Khetha, P.S. Kasimpur, District Hardoi is
involved and detained in case crime no. 202/2010, under Sections 419/420
IPC and 8/9/12 Anti Corruption Act, from P.S. Hasanganj, District Lucknow
and he has applied for bail.
The submission of learned counsel for the applicant is that as per prosecution
case accused used to take money from unemployed youths to get them
employed. The police had recovered Rs. 1 lakh and certificate of one Swami
Narain from the house of the accused. Learned counsel submits that the entire
prosecution story is false and fabricated. In fact the amount recovered from
house of the accused belong to him. He had kept this amount for performing
the Tilak ceremony of his marriage. The Investigating Officer has not
collected any evidence to show that the accused used to take money from
unemployed youths to get them employed. The accused, therefore, deserves to
be released on bail.
Learned A.G.A. opposed the bail application.
Considered the submission of learned counsel for the applicant and learned
A.G.A. Keeping in view the totality of the facts and circumstances of the case
without expressing any opinion on the merit of the case, the accused may be
released on bail.
Let the applicant Neeraj Kumar Verma be released on bail on his furnishing a
personal bond of two sureties each in the like amount to the satisfaction of the
court concerned.
