Background
1. The Applicant filed an RTI application dt.20.10.08 with the PIO & Sr.DMM, NR,
Ferozepur requesting for the following information:
i) From which milestone area of Ferozepur division (on Bathinda-Abohar line)
begins.
ii) From which milestone area of Ferozepur division (on Bathinda-Abohar line)
ends.
The PIO & Sr.DMM, Ambala Cantt replied on 18.11.08 enclosing reply dt.17.11.08
received from Sr.DEN-II, Ambala Cantt who replied ‘Nil’ against each point. Not
satisfied with the reply, the Applicant filed an appeal dt.25.11.08 with the Appellate
Authority, DRM office, Ferozpur . The CPIO, Ferozpur division transferred the
application to Ambala Division vide letter dt.3.11.08. The Appellant however wondered
whether as per the information given, Ferozpur division begins at Nil milestone and
ends at Nil milestone which means that Ferozpur division does not exist at all. He also
enclosed a railway plan in which it is clearly shown that FZR division begins at
milestone M-217.176. Shri R.S.Ghera, ADRM & Appellate Authority replied on 23.1.09
stating that as per latest system map of Northern Railway (NRHQECP) No.HQ/02/05
(2007), Bathinda Hindumalkot line is now part of Ambala Division and the plan
enclosed by the Applicant is an old one and subsequently the geographical jurisdiction
of DLI and FZR divisions have been revised with formation of Ambala Division. Thus
the information pertains to Ambala Division only and hence the informationprovided to
him is correct. Being aggrieved with the reply, the Applicant filed a second appeal
dt.15.1.09 before CIC.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner, scheduled the hearing
on December 22, 2009.
3. Shri Giridhar Singh, PIO and Shri J.K.Bansal, SSE(Works), KKP represented the Public
Authority.
4. The applicant was not present during the hearing.
Decision
5. The Commission after reviewing the documents placed before it and while holding that
available information has been provided by PIO Ferozepur, directs the PIO, Northern
Railway, Ferozepur Division to transfer the RTI application to the PIO, Northern
Railway, Ambala Division and directs the PIO, Northern Railway, Ambala Division to
provide the information directly to the Appellant by 25 January, 2009.. The Appellant
is directed to submit a compliance report to the Commission by 30 .1.2010.
7. The appeal is accordingly disposed off.
