ORDER

Shri S.L. Peeran

1. When the case was called, none appeared for the appellants. Appellants through their Regional Manager have sent a fax dated 18.4.2001 stating that they do not wish to contest the appeal and seek for a suitable order.

2. Ld. D.R. submits that the impugned order is a correct order and there is no illegality or infirmity in the same. It pertains to eligibility and abatment of duty levied on packaging charges in respect of re-exported goods after repair works. The Commissioner has give a detailed finding and has correctly passed the order. For that reason the appellants are not pursuing the appeal. Hence, he seeks for dismissal of the appeal.

3. On a careful consideration, we notice that the appellants have filed a memo seeking dismissal of the appeal as withdrawn as they are not interested in contesting the issue. In view of the memo filed, the appeal is dismissed as not contested.
