This petition is for anticipatory bail.

2. The alleged offences are under Sections 143, 147,

323, 332 and 149 IPC and Section 3(2)(i) of PDPP Act.

According to prosecution, on 19.7.2008, at about 11.45 a.m.,

while a cluster meeting was going on in a school premises,

petitioners along with others formed into an unlawful assembly

and trespassed into the hall and caused hurt to the defacto

complainant, who is a public servant, with intention to deter him

from discharging his duty. The students in the school were also

driven out.

3. Learned counsel for the petitioners submitted that the

petitioners are accused nos. 1 to 3 and they may be granted

anticipatory bail.

4. This petition is opposed.

5. On hearing both sides, considering the nature of

allegations made, I do not think it fit to grant anticipatory bail.

The incident occurred as early as on 19.7.2008 and petitioners

BA No.6067/08 2

could not be arrested so far.

Hence, petitioners are directed to surrender before

the Investigating Officer within seven days from today

and co-operate with the investigation.

With this direction, this petition is dismissed.
