                W.P.C. NO. 8539 OF 2009 J
                --------------------------------------
Dated this the 30th March, 2009

                          JUDGMENT

Petitioner has been assessed under the Building Tax Act.

He carried the matter in Appeal. It was rejected citing delay. He

took up the matter further before the District Collector in

Revision. It is stated that it is not possible to consider the

Revision Petition, in view of non-payment of fifty per cent.

2. I heard the learned counsel for the petitioner and the

learned Government Pleader. Learned counsel for the petitioner

would submit that the petitioner is prepared to pay fifty per cent

as demanded and the Revision Petition may be ordered to be

considered. The Writ Petition is disposed of directing the

second respondent to consider and take a decision on Ext.P4

Revision Petition in accordance with law, upon the petitioner

remitting the amount required in law and on condition that the

Revision Petition has been preferred in time. A decision will be

taken within two months from the date of receipt of a copy of

WPC.8539/09 J 2

this Judgment. Petitioner is granted one week’s time from today

to pay the amount.
