JUDGMENT
When
the matter is taken up for final hearing, Mr.Ramnani, learned
Counsel for the petitioner, states that he is desirous to withdraw
the petition with a view to file an application for restoration of
Civil Misc. Application No.6 of 2002 before the same Court; namely
Civil Judge (S.D.), Gandhidham, Kutch.
Mr.Soni,
learned Counsel for the respondent, contended that if the said
application is made, rights and contentions of his client should
also be kept open.
Considering
the facts and circumstances, permission is granted with liberty to
the petitioner to make an application for restoration of Civil Misc.
Application No.6 of 2002 before the same Court. However, if such an
application is made, rights and contentions of both the sides, in
accordance with law, shall remain open and the trial Court shall
examine the application in accordance with law, without in any
manner influenced by any observations made in this order.
Disposed
of accordingly. Rule discharged.
