Background
1. The Applicant filed his RTI request on 22.09.07 with the PIO / East Central Railway,
Dhanbad requesting for information related to acquisition of plots of land acquired by
the Railways around village Labanga under Ramgarh police station in Hazaribagh
district in 1925 including the details of land acquired, names of plots, dates of
acquisition etc. The PIO replied on 05.11.07 providing some information. Not
satisfied with the reply, the Applicant filed his First Appeal on 12.11.07 reiterating his
request for the information. The Appellate Authority replied on 18.03.08 providing
further pointwise information. However, still not satisfied with the reply from the
Appellate Authority, the Applicant filed a Second Appeal before the Commission on
15.12.08.
2. The Bench of Mrs. Annapurna Dixit, Information Commissioner scheduled the
hearing for 17th December, 2009.
4. Mr. B.K. Singh, Sr.DPO & CPIO, Mr.Goutam Banerjee, ADRM & Appellate Authority,
Mr.Niraj Kumar, Sr.DEN(3) & Deemed PIO and Mr.Amitav Banerjee, Head Clerk &
Incharge, RTI Cell represented the Public Authority.
5. The Appellant was present during the hearing.
Decision
6. The Respondent submitted that available information has already been provided to the
Appellant. Since information pertains to the year 1925, no records of that period are
traceable. However, according to the Appellant, they were able to locate a very old
map showing the village Labanga of the said period. However, the map did not show
any plots acquired by the Railway. Hence no information could be provided. He also
added that in response to another RTI Application on the same issue, the map has also
been provided to the Appellant. . The Commission holds that available information has
been furnished to the Appellant and accordingly, disposes off the Appeal.
