Heard learned counsel for the applicants, learned A.G.A. for the State and
perused the record.
Learned counsel for the applicants has contended that there are cross cases
and from side of the applicant Pyare has received 8 injuries and most of the
injuries are grievous in nature and other persons have also received injuries.
The applicants are in jail since 25.4.2010.
Learned A.G.A. has contended that the applicants were involved in
committing murder of the deceased and they inflicted injuries to the injured
persons by lathi and danda.
There are cross cases. Both sides have sustained injuries.
Considering the nature of accusation and the severity of punishment in case
of conviction and the nature of supporting evidence, reasonable apprehension
of tampering of the witnesses and prima facie satisfaction of the court in
support of the charge, the applicants are entitled to be released on bail.
Let the applicants Vijai, Ram Pyare, Vinod, Harman, Sunil, Kailash and
Ramesh involved in case crime no. 481 of 2010, under section 147, 148, 304,
323 IPC, P.S. Didarganj, District Azamgarh be released on bail on their
furnishing a personal bond with two sureties each in the like amount to the
satisfaction of the court concerned.
