                          J U D G M E N T

The petitioners are decree holders in E.P.No.42/2003 in

L.A.R.No.64/1986 on the file of the Additional Sub Court, Kottayam.

Prayer sought in this writ petition is to direct the Sub Court to hear

and decide the dispute upon statement of account filed by the

parties.

2. Pursuant to the directions of this Court, a report has

been obtained from the Sub Court. From the report it is seen that

as per the statement filed by the judgment debtor, the balance

amount due is Rs.3,98,381.18, and as per the statement filed by the

4th decree holder, the balance amount due is Rs.72,67,922/-. It is

stated that in view of the disparity in the amount shown in the

statements, the case was taken up for hearing on 08/03/2010, and

at the request of the judgment debtor, the case now stands posted

to 09/06/2010. It is also reported that the matter is likely to be

listed before the Lok Adalat, which is scheduled to be held on

WP(C) No.7743/2010

27/03/2010, and that if the issue is not settled, the case will be

heard on 09/06/2010.

From this report thus received from the Sub Court, I am

satisfied that there is no delay or latches caused by the Court and

the matter is engaging the attention of the Sub Court. In such

circumstances, I decline to pass any further direction in the matter.

The writ petition is accordingly closed.
