cases, and to provide him with attested copies of documents required by him including all the information

ORDER
Background
CIC/AD/C/2011/000210
1. The Applicant filed an RTI application dt.14.9.10 with the PIO, AIIMS seeking inspection of records
relating to post graduate medical admissions in AIIMS. Apart from inspection, he also sought
information against 14 points. Shri V.P.Gupta, Registrar, replied on 17.9.10 stating that since the
subject matter of the inspection of records under the provision of RTI Act is subjudice before the High
Court, Delhi, request cannot be accepted at this stage. Being aggrieved with the reply, the Applicant
filed a complaint dt.12.1.11 before CIC.

2. The Applicant filed an RTI application dt.7.8.10 with the PIO, AIIMS seeking information against
seven points. Shri V.P.Gupta, Registrar, replied on 27.8.10 stating that since the subject matter of
the information sought is subjudice before the High Court, Delhi, request cannot be accepted at this
stage. Being aggrieved with the reply, the Applicant filed a complaint dt.29.1.11 before CIC.
Decision
3. During the hearing, the Appellant submitted that the subject matter of his RTI applications is no
longer subjudice as the High Court has already passed a decision.
4. In view of this submission, the Commission directs the PIO to allow inspection of all the documents
as sought by the Appellant, in both cases, and to provide him with attested copies of documents
required by him including all the information sought against the 14 points as explained in para no.1.
The Appellant may be provided 50 pages of information free of cost and charged at Rs.2/ per page
for pages beyond that number. The entire exercise to be completed by 26.5.11 and the Appellant to
submit a compliance report to the Commission by 2.6.11.
5. The appeal is disposed of with the above directions.
