6 30.08.2011 Counsel for the appellant submits that P.W.1 and

P.W.2 who are allegedly the eye witnesses have stated for the

first time in court that Ragho Yadav fired on the deceased. It

is submitted that the attention of the Investigating Officer was

drawn to this fact that which will be evident from the

evidence of the witnesses.
