The petitioner seeks quashing of the order dated

27.9.2008 by which the Chief Judicial Magistrate, Madhubani,

has taken cognizance in Khajauli P.S. Case No. 213 of 2008.

Since the petitioner has sought quashing on his

plea of defence, I am not inclined to interfere in the matter.

The application is dismissed.
