 This matter was heard on 05.05.2009 in the presence of both
parties.
2. Appellant, through his RTI-application dated 22.09.2008, asked
over 200 questions. Respondents, through CPIO’s communication dated
30.09.2008 and the Appellate Authority’s order dated 24.11.2008,
provided to the appellant certain basic information such as all Lab
Diaries. As regards the other parts of the information, it was stated
that they were not obliged to answer these as these were explanatory
in nature.
3. Appellant, who seems to be an educated person and a scientific
officer himself, is expected to exercise moderation and discretion in
asking RTI-related questions. More precisely, he ought to know that
when questions running into hundreds are asked, this borders on the
misuse of the RTI Act.
4. I find the queries to be not only outside the scope of Section 2(f)
of the RTI Act, but also to be vexatious.
5. There will be no obligation cast on the respondents to answer
these queries.
6. Appeal disposed of with these directions.
7. Copy of this direction be sent to the parties.
