                             O R D E R

This is an application for bail under Sec. 12 of the Juvenile

Justice (Care and Protection of Children) Act, 2000 filed by the

father of a juvenile in conflict with law (“JCL” for short) by name

Shambu Prasad @ Shambu who is allegedly involved as the 4th

accused in a murder case registered as Crime No. 3201 of 2010

of Kottarakkara Police Station. The occurrence took place on

19-12-2010 and the injured succumbed to the injuries on 21-`12-

2010 in the hospital. The “JCL” was arrested on 28-12-2010.

2. I heard the learned counsel for the petitioner and the

learned Public Prosecutor. I also called for a report from the

District Probation Officer, Kollam. After perusing the report

of the District Probation Officer, I am inclined to grant bail to the

JCL on the petitioner executing a bond for ` 5,000/- (Rupees

five thousand only) with two solvent sureties each for the

like amount to the satisfaction of the Juvenile Justice

Board, Kollam and subject to the following conditions:-

B.A. No. 168 of 2011 -2-

i) The JCL shall be liable to be interrogated by the
investigating officer as and when necessary during the
stage of investigation of the above crime.

ii) The petitioner shall undertook that he will not, on
release of the JCL, bring him to associate with any
known criminal or expose him to moral, physical or
psychological danger .

iii) Petitioner shall place the JCL under the supervision
of the Addl. District Probation Officer, Kollam who in
turn, shall ensure that the JCL pursues his studies and
does not associate with criminals or is exposed to any
moral, physical or psychological danger.

iv) The petitioner shall ensure that no witness of the
prosecution is intimidated or influenced by or at the
instance of the JCL.

v) Petitioner shall ensure that the JCL does not get
himself involved in any crime or dangerous activity
while on bail.

vi) The petitioner shall vouch for the safety of the JCL.

This application is allowed as above.
