Rule.
Ms
Mita Panchal, learned APP, waives service of rule for respondents.
The
applicant-convict has prayed for temporary bail on the ground of
marriage of his nephew ? Kaushik.
In
the facts and circumstances of the case and looking to the mood of
the Court learned counsel for the applicant does not press the
application for temporary bail. However, it is submitted by
learned advocate for the applicant that the applicant may be
permitted to visit the site of the marriage for 3 days.
Accordingly, in view of the particular facts and circumstances of the
case, it is directed that the jail authorities will permit the
accused to visit the site of the marriage, in custody, for 3 days,
the date of marriage being the intervening day.
The
bail application is dismissed with the aforesaid directions. Rule is
discharged. D.S. permitted.
