Heard learned counsel for the petitioner, learned A.G.A. for the State and
perused the material on record.
It has been pointed out that the matter relates to an offence committed in the
year 1978 in respect of which charge-sheet was filed in 1981 and the
concerned case is pending since 1982, wherein charges were framed on
18.01.1990 but despite passing of two decades, no prosecution witnesses
could have been examined as yet.
In view of above, let present status report of the case be called from the court
concerned [I Additional Civil Judge (Junior Division)/Judicial Magistrate,
Bahraich] relating to Case Crime No.54 of 1979 under section 409 I.P.C. of
Police Station Sirsia, District Bahraich through the Sessions Judge Bahraich,
by FAX along with the reasons of the delay in disposal of the case, before the
next date of listing.
