JUDGMENT

1. Against the interim order made by learned Single Judge, appeal was preferred and at the initial stage Division Bench hearing the matter directed that in the meantime, authorities may proceed with the hearing pursuant to the WA 651/04 Page 1 of 2 show cause notice. However, no final order was to be passed till the next date of hearing. That order was passed on 16.6.2004
2. The main petition is still pending before learned Single Judge.
3. Learned counsel for the parties are in agreement that let the inquiry be completed and order be passed by the Competent Authority. The same may be placed in a sealed cover without giving any publicity and may be placed before the learned Single Judge for appropriate directions.
4. It goes without saying that this order as well as the order that may be passed by the authorities shall be without prejudice to the rights of the parties.
5. The appeal stands disposed of accordingly.
