                -----------------------------------------------------------
Dated this the 31st May, 2010.

                                    JUDGMENT

The petitioner is a candidate whose name has been included

in the rank list for appointment to the post of junior clerks.

Appointments to the posts of junior clerks are to be made from the

list submitted by the Co-operative Service Examination Board, after

complying with the conditions stipulated in Rule 182(4) of the

Kerala Co-operative Societies Rules. Therefore, the petitioner

should have been appointed to one of the posts that has fallen

vacant subsequent to the publication of the list. The complaint of

the petitioner is that the second respondent society instead of

appointing persons from the list have been filling up the said

vacancies by promoting persons from the posts of peons/attenders.

The above procedure would only result in denial of appointment to

the petitioner that is legitimately due to her. Though the petitioner

has submitted Ext.P1 representation before the first respondent, no

orders have been passed thereon till date. The petitioner therefore

seeks appropriate directions for an early disposal of Ext.P1. The

learned senior Govt. Pleader has no objection to such a direction

being issued.

WPC 16529/2010 2

2. In the above circumstances, this writ petition is disposed

of directing the first respondent to consider the representation of

the petitioner evidenced herein by Ext.P1 in accordance with law

and to pass appropriate orders thereon as expeditiously as possible

and at any rate within a period of one month from the date of

receipt of a copy of this judgment.
