Learned counsel for the State has pointed out that the matter with

regard to the facts stated in the affidavit annexed by the petitioners with the

petition regarding illegal confinement of the petitioners in the police station was

inquired into by the SP(D) and it was found that the facts as claimed by the

petitioners were not proved. ASI Kaur Singh stated that Charanjit Singh and

Nishan Singh have stated before the SP(D) that they had signed the affidavits

without knowing the contents thereof, otherwise the incident so projected by the

petitioners did not happen.

In view of the aforesaid stand of State, learned counsel for the

petitioners submitted that it is a case of perjury. The aforesaid two persons

namely Nishan Singh and Charanjit Singh had earlier sworn affidavit supporting

the contents stated by the petitioners whereas now under pressure they are

backing out by not denying the contents of affidavit. She seeks permission to

withdraw the present petition with liberty to take appropriate action in accordance

with law.

Dismissed as withdrawn with liberty as prayed for.
