1. In all the three Miscellaneous Applications, the prayer is for condonation of delay in filling the appeals.
2. Shri K.P. Dey, ld. Advocate appearing for the applicants, submits that when the order was issued in May, 1999, all three of them were in Jail under COFEPOSA Act. On their release from the Jail, they received a letter from the Superintendent asking them to deposit the amount of penalties imposed upon them vide the impugned order. Inasmuch as, the appellants had not received the said order, they approached the Superintendent for supply of copy of the same. Copy of the order was supplied to them by the Superintendent under the cover of his letter dated 20.2.2001. Thereafter, the appeal was filed within three months. As such, ld. Advocate prays inasmuch as the appeal was filed within a period of three months from the date of receipt of the impugned order, there is no delay and if at all it is considered that there is a delay, the same should be condoned in view of the facts narrated above.
3. Shri V.K. Chaturvedi, ld. SDR appears on behalf of the Revenue.
4. In view of what has been stated above, I find that inasmuch as the appeal has been filed within a period of three months from the date of receipt of this order, the same is required to be treated as having been filed within limitation. Miscellaneous Applications are accordingly disposed of. Stay petitions are fixed for hearing on 10th July,2001.
