Mr. Arun Kumar, learned counsel for the petitioner,
submitted that petitioner has not received any order passed on his
application for Arms License for N.P. Bore Pistol/Revolver, made
before the Deputy Commissioner cum Licensing Authority, Dhanbad.
Mrs. Richa Sanchita, learned counsel for the State,
submitted that in absence of counter affidavit, she is not in a position
to accept or controvert the statements made in the writ petition. She
further submitted that petitioner has applied for license generally
saying that he requires it for safety of him and his property and he
has not made any good grounds why the license should be granted
to him.
On this counsel for the petitioner submitted that at least
petitioner should have been communicated some order passed on his
application.
In the circumstances, petitioner is permitted to make a
fresh representation before the Deputy Commissioner cum Licensing
Authority, Dhanbad ( respondent no. 3). If any order has already been
passed on petitioner’s application, the same should be communicated
to him. If no order has been passed, order should be passed and
communicated to him in accordance with law, as early as possible
and preferably within two months from the date of receipt of such
representation.
It is made clear that this Court has not gone into the
merits of the claim of the petitioner.
With these observations and directions, this writ petition
is disposed of.
