ORAL ORDER
Petitioners
are relieved from service of the respondent during the period of
probation and in terms of the orders of appointment. As stated in the
order terminating services, the petitioners have not performed
satisfactorily in the functional knowledge test and have not secured
the minimum qualifying marks for confirmation. Even after being
granted a second chance to obtain the minimum marks at the test, they
are found to be not fit for confirmation as officers under the
respondent. Learned counsel, Mr. K.K.Shah vehemently argued that the
petitioners could have been given the extension of probation and
additional chance for clearing the test. It was also submitted that
the other officers, absorbed from other subsidiary banks, were not
put to such test for confirmation. These submissions having no
factual or legal basis, they are rejected. The termination of
service of the petitioners being in conformity with the stipulations
made in the appointment orders and the Officer’s Service Rules of the
respondent, no relief can be granted to the petitioners and, hence,
the petitions are summarily dismissed.
