Court No. - 38 Civil Misc. Restoration Application No. 104438 of 2010 IN Case :- WRIT - A No. - 54798 of 2003 Petitioner :- Jamuna Prasad Sharma Respondent :- State Of U.P. And Others Petitioner Counsel :- D.K. Tripathi,D.S.Pandey,S.Nandon Respondent Counsel :- C.S.C.,N. Mishra,R.G.Tripathi Hon'ble Shishir Kumar,J.
Heard learned counsel for the petitioner, Sri Ram Gopal Tripathi,
learned counsel for the respondents and learned Standing Counsel.
This writ petition has been filed by a counsel, who was not counsel
of the petitioner at the time when the writ petition was dismissed
in default. I have already taken a view that the application was not
maintainable. Learned counsel for the applicant submits that the
earlier counsel, who was not a senior counsel on the day when the
writ petition was filed, has become a senior counsel and if his
name is mentioned in the body of the application, whether it can be
treated to be filed by the proper counsel.
In my opinion, the contention of the applicant is not correct.
Therefore, the application is hereby dismissed.
No order as to costs.
