Title: Further discussion on the Constitution (Amendment) Bill, 1999 (Omission of Article 44) moved by Shri Yogi Aditya Nath on 19.07.2002 (Bill withdrawn)
MR. SPEAKER: Now, the House shall take up Item No. 26 — Submission to the Vote of the House of the following motion moved by Shri Yogi Aditya Nath on the 19th July, 2002, namely:–
“That the Bill further to amend the Constitution of India, be taken into consideration. ”
स्वास्थ्य और परिवार कल्याण मंत्री तथा संसदीय कार्य मंत्री (श्रीमती सुषमा स्वराज) : अध्यक्ष जी, इस सम्बन्ध में मैं माननीय सांसद से आपके माध्यम से अनुरोध करना चाहूंगी, मैं माननीय सांसद से बहुत विनम्रता से यह कहना चाहूंगी कि उनके द्वारा प्रस्तुत किया गया विधेयक साधारण विधेयक नहीं है, संविधान संशोधन विधेयक है। संविधान संशोधन विधेयक को पारित करने के लिए सदन में ५० प्रतिशत की उपस्थिति और उपस्थित सदस्यों का दो तिहाई बहुत चाहिए होता है। सदन में इतनी संख्या जुटाने के लिए सर्वदलीय सहमति बनानी बहुत आवश्यक है, अकेले एक दल की सहमति से इस तरह का संशोधन विधेयक पारित नहीं हो सकता। सरकार राष्ट्रीय सहमति बनाने का प्रयास करेगी और उसके बाद ही सरकार यह विधेयक ला सकती है। इसलिए मैं उनसे चाहूंगी कि वे इस बिल को विथड्रा करें, क्योंकि आगे के बिल इसलिए नहीं आ पा रहे हैं, क्योंकि इस बिल पर वोटिंग नहीं हो पा रही है, मत विभाजन नहीं हो पा रहा है। मैं चाहूंगी कि माननीय सांसद मेरे इस अनुरोध को स्वीकार करें और इस बिल को विदड्रा करें।
SHRI SOMNATH CHATTERJEE (BOLPUR): It will be rejected.MR. SPEAKER: I would like to bring it to the notice of the House that we have already started the process of voting in this particular case. But if the House agrees, he can be permitted to ask for permission to withdraw the Bill.

श्री रामजीलाल सुमन : अध्यक्ष महोदय, सरकार अपनी मंशा बताये कि सरकार की मंशा इस बिल के बारे में क्या है। दूसरे, यह राष्ट्रीय जनतांत्रिक गठबन्धन की सरकार है या बी.जे.पी. की सरकार है, यह भी तय हो जाना चाहिए।
अध्यक्ष महोदय : मैंने आपको बोलने की इजाजत नहीं दी है। श्री धनंजय कुमार जी आप क्या कहना चाहते हैं ?
: I would like to make a humble submission that since this is a Constitutional Amendment Bill, to initiate the process of voting, the mandatory minimum requirement is the presence of more than 50 per cent of the membership of the House. … (Interruptions) Have I no right to make a submission? You have all been making submissions; let me also make a submission.
Only if we have more than 50 per cent of the membership of the House present during voting, we can take it up. Otherwise, we cannot take it up for voting. That is the technical situation.

Now, a situation has arisen wherein the mandatory requirement of the presence of more than 50 per cent of the membership of the House is not there. So, we cannot take it up for voting. Let the Member be heard and if he is ready to withdraw it, it is fine.
