Heard learned counsel for the applicant, learned A.G.A. and perused the entire
record of the case.
As alleged accused applicant wanted to get registered the property of his
grand-father in his name. On the alleged date, some harsh words were
exchanged by the accused applicant with his grand-father and the accused
applicant fired on him causing injury on the back of left side of head. The X-
ray report (Annexure-2) does not indicate the nature of the injury whether it
was grievous or simple. There is no indication whatsoever regarding any
internal damage. It is also contended that the accused applicant is in jail since
9.5.2009, as averred in para 12 of the bail application and the applicant is a
student of B.A. IIIrd year and has no criminal history, as averred in para 9 of
the bail application, which is admitted by the State.
Considering the overall aspects of the matter, I hereby provide that the
applicant be released on bail in Case Crime No.852/2009, under Sections 307,
504, 506 IPC, P.S. Kotwali, District Sitapur, on his filing a personal bond and
two sureties each in the like amount to the satisfaction of the court concerned.
