Learned
advocate Shri Pardiwala for the applicants submitted that in
paragraph-3 of the suit, the plaintiffs have stated inter-alia that
the family property was illegally partitioned on 27.10.1957. He
therefore, submitted that suit was ex-facie barred by limitation
despite which learned Judge rejected the application of the
applicants under Order 7 Rule 11 of the Civil Procedure Code.

Issue
