2. 09.08.2010. Heard learned counsel for the
petitioners and counsel appearing for the
State.
The petitioners are apprehending their
arrest in a complaint case in which cognizance
has been taken under Sections 498(A), 494,307,
379 and 406 of the I. P. C. and section ¾ of
the D. P. Act.
It is submitted by the learned counsel
for the petitioners that petitioner no. 2 is
the father-in-law and petitioner no. 3 is wife
of brother of the husband. There is general
allegation against petitioner nos. 2 and 3.
Moreover, petitioner no. 3 has filed the case
against the complainant’s family as contained
in Annexure-3.
Considering the aforesaid submissions,
let the petitioner nos. 2 and 3, namely, Nago
Paswan and Rajni Devi, be released on bail in
the event of their arrest or surrender before
the learned court below within a period of
twelve weeks from today in connection with
complaint case no. 59 of 2009 on furnishing
bail bond of Rs. 10,000/-(Ten Thousand)each

with two sureties of the like amount each to
the satisfaction of the learned C.J.M.,
Madhepura, subject to the conditions as laid
down under Section 438(2) of Cr.P.C.
So far petitioner no. 1, namely, Ashok
Paswan being the husband is concerned, he is
ready to keep the complainant as wife with full
dignity and honour.
Let notice be issued to opposite party
no.2 by registered post with A/D as well as
under ordinary process for which requisites
etc.,must be filed within two weeks.
Let the ordinary process of notice be
served upon the complainant through her lawyer
in the learned court below through the office
of the learned C.J.M., Madhepura in complaint
case no. 59 of 2009.
Let the petitioner and opposite party
no.2 appear in person on 27.09.2010 before this
court.
Let no coersive steps be taken against
the petitioner no.1, namely, Ashok Paswan, in
the meantime in complaint case no. 59 of 2009
pending in the court of the learned C.J.M.
Madhepura.
