ORDER
Shri Amarjeet Singh, the appellant has filed this appeal dated nil before the
Commission against the Northern Coalfields Ltd. (NCL), Singrauli, for not providing
information to his RTI-request dated 20.5.2010. The matter came for hearing on
04.11.2011. The appellant was absent, whereas the respondents were represented by
Shri Birat Chandra Mondal, CPIO.
2. The appellant filed an RTI-request dated 20.5.2010 seeking copy of medical report
of his age at the time of joining Khadia Project of NCL. The CPIO vide letter No.
NCL/SGR/RTI-107(10-11)/10/1765 dated 27.7.2010 provided the requisite information to
the appellant as obtained from Khadia Project vide letter No. 659 dated 7/9.7.2010.
3. Aggrieved by the non-receipt of information within stipulated period, the appellant
preferred first-appeal on 22.6.2010 before FAA, NCL, Singrauli. The appellant has not
received FAA’s order till the filing of his second appeal before the Commission.
4. The appellant states in his appeal filed before the Commission that he has not
been provided the requested information within the time limit specified in the RTI Act by
the CPIO. Moreover, the document provided to him does not have the signature or stamp

of the doctor. The respondent on the other hand stated that the said document, as
received from the holder of the information has been provided to the appellant.
5. Having heard the respondent and perused the relevant documents in file, the
Commission observes that there has been an undue delay on the part of the CPIO in
providing the information to the appellant, having received the required information from
Khadia Project on 7.7.2010, the CPIO provided the information to the appellant only on
27.7.2010. The CPIO, NCL has prima-facie caused a delay of 20 days in supplying
information to the appellant. A separate show-cause notice u/s 20(1) of the RTI Act
would be issued to the CPIO, NCL, Singrauli asking him to show-cause as to why a
penalty @ Rs. 250/- per day, should not be imposed upon him, for the delay of 20 days
caused in providing information to the appellant.
6. As far as the information part is concerned, the CPIO, NCL is hereby directed to
provide authenticated copy of the medical report to the appellant, within two weeks of the
receipt of this order.
