Facts

:­ 

1. The applicant preferred RTI request of 12 August 2009 before the 
CPIO, Zonal Accounts Office, CBDT, Patna to seek information through 
eight points pertaining to release of revised pension to him.

2. Not receiving a response from the CPIO, the applicant preferred 
appeal dated 19 September 2009 before the first appellate authority which 
was disposed of vide FAAO of 6 November 2009. Through his order the 
first  appellate authority  directed the  CPIO  to  provide  information  to  the 
applicant.

3. Being aggrieved and not being satisfied, the applicant submitted 
second   appeal   before   the   Commission.   The   matter   was   heard   today 
through videoconferencing. Appellant did not appear. Respondents were 
present as above and presented arguments.

4. The first appellate authority, Kolkata provided a full background of 
the case. CPIO submitted that a blank IPO had been submitted by the 
appellant along with his RTI application and that was the reason for not 
providing him with information. But on receiving directions from the first 
appellate   authority,   CPIO   asked   the   appellant   to   provide   certain 
documents which were deficient in their record as that would assist him in 
providing full and complete information to the appellant and also to redress 
his   grievance.   He   also   wrote   to   the   Department   to   provide   additional 
information.

5. As   per   the   averments   of   the   CPIO,   appellant   provided   part 
information and also met with the CPIO on one occasion on the matter of 
his RTI application.

Decision

6. Appellant is directed to furnish the additional documents sought by 
the CPIO following which full and complete information is to be provided to 
the appellant within two weeks thereafter.

7. The matter is closed at the Commission’ s end with directions to the 
CPIO   not   to   turndown   RTI   applications   on   technical   grounds   and     in 
keeping with the spirit of the Act take a more liberal view while providing 
information  under  he Act.
