This application under section 5 of the
Limitation Act is filed by the appellant for condonation
of delay of 43 days occurred in filing the Letters Patent
Appeal.

On the facts and in the circumstances of the

case, the delay is condoned.

Interlocutory Application stands disposed of.
LPA. No.1890 of 2010
This Appeal preferred by the writ petitioner
under Clause 10 of the Letters Patent arises from the
judgment and order dated 23rd August 2010 made by the
learned Single Judge in above CWJC. No.12611 of 2010.
The appellant’s claim for compassionate employment in
the respondent State Bank of India made 14 years
after it was rejected on 21st June 1995 has been rejected
by the learned Single Judge.

The claim is ex facie belated and could not
have been accepted by the court. Besides, learned
advocate Mr. Kaushlendra Kr. Sinha has submitted that
the scheme for compassionate employment in the State
Bank of India has been abolished since the year 2005.
In either view of the matter, the appellant is not entitled
to compassionate employment more than 15 years after
the death of his father.

No case for interference is made out.
The Appeal is dismissed in limine.
