Heard learned counsel for the applicant and learned A.G.A.
The applicants are accused in case crime no. Nil of 2007 (N.C.R. 250 of
2007) under sections 323, 504 and 506 I.P.C., pending in the court of Chief
Judicial Magistrate, Aligarh, P.S. Banna Devi sub division, District-Etah.
This application has been filed with a prayer that a suitable direction may be
issued to the courts below for disposal of the bail application of the applicant
on the same day.
From the perusal of the record, it appears on the basis of the material collected
by the I.O. prima facie offences are made out. There is no illegality in the
charge sheet, therefore, such prayer is refused.
After perusing the record and considering the nature of the allegations it is
directed that the applicant moves application for appearance/surrender before
the court concerned within 30 days from today on which the court concerned
shall fix the date of surrender/appearance, in the meantime the court
concerned shall seek the instructions from the prosecution side. In case the
applicant moves the application for bail on the day of the appearance or
surrender, the same shall be considered and disposed of on the same day by
the courts below.
With this direction, the application is finally disposed of.
