ORDER
1. When
the matter was taken up for hearing, Mr. P.V. Hathi, learned counsel
appearing on behalf of respondent no.3, submitted that some
reasonable time may be granted for completing the inquiry
proceedings.
2. Heard.
The inquiry proceedings were initiated in the year 2008. Therefore,
by now, they ought to have been completed. Be that as it may, if a
period of six months is granted to the concerned authority to
complete the inquiry proceedings, in my opinion, the same would meet
with the ends of justice.
3. Mr.
B.D. Karia, learned counsel for the petitioner, has no objection if a
period of six months is granted for completing the inquiry
proceedings.
4. In
view of the above, the concerned respondent-authority is directed to
complete the inquiry proceedings within a period of Six Months from
the date of receipt of writ of this order. It is expected that the
petitioner shall fully co-operate in the said proceedings so as to
ensure that the proceedings could be concluded within the stipulated
period. It is, however, observed that if the concerned
respondent-authority is not in a position to complete the inquiry
proceedings within the period stipulated herein above, then it may
file appropriate application before this Court praying for extension
of the time-limit by pointing out cogent & convincing reasons, in
which case, appropriate orders shall be passed at the relevant time.
With the above observations and direction, the petition stands
disposed of.
