Heard learned counsel for the applicant, learned A.G.A. for the State and
perused the record.
Learned counsel for the applicant has contended that the applicant was not
named in the FIR and thereafter the statement of witness Ranveer has been
recorded who was not person in authority and there is allegation that accused
persons including the applicant had made extra judicial confession before him
but it has been fabricated and recovery shown from possession of the
applicant, has also been fabricated by the police. The applicant is in jail since
16.7.2009.
Learned A.G.A. has contended that the deceased was kidnapped and
murdered and there was demand of Rs. 1 lac as ransom amount.
Co-accused Rahil has been allowed bail by this court and Anurag has been
allowed bail by the Special Judge (SC/ST Act), Meerut on 1.2.2010. The
applicant was not named in the FIR. Prima facie it was not proved that
telephonic call was made by the applicant.
Considering the nature of accusation and the severity of punishment in case of
conviction and the nature of supporting evidence, reasonable apprehension of
tampering of the witnesses and prima facie satisfaction of the court in support
of the charge, the applicant is entitled to be released on bail.
Let the applicant Vimal Saini involved in case crime no. 237 of 2009,
under section 364A, 302, 201, 404, 411 IPC, P.S. Civil Lines, District Meerut
be released on bail on his furnishing a personal bond with two sureties each in
the like amount to the satisfaction of the court concerned.
