Heard
the learned Advocate appearing on behalf of Mr H.S. Munsha, learned
Advocate for the applicant.

I
have considered the averments made in the application as well as the
order passed by the Coordinate Bench of this Court in Civil
Application No. 10719 of 2009. Though the Coordinate Bench has fixed
the matter for final hearing and direction is given to list the
matter on final hearing board, the matter is not yet listed on board.
In view of the above, the office is directed to list the matter on
final hearing board in the week commencing from 1st
September, 2010.

With these
observations, this Civil Application is allowed.
