02. 16.08.2010 Heard learned counsel for the petitioner and
learned counsel for the State.
The petitioner was placed under suspension
on 29.1.2009. It is his case that the departmental
enquiry has concluded and report submitted on
27.11.2009, notwithstanding which the suspension
continues and the proceedings remain inconclusive to
urge revocation of the suspension.
Reliance is placed on an order of this Court
in C.W.J.C. No. 11675 of 2010 filed by a co-delinquent
more particularly on the following extract from the
order:-
“Let the representation of the
petitioner be disposed of within a
maximum period of four weeks from the
date of receipt/production of a copy of
this order in light of the aforesaid
discussion.
If no final appropriate orders
2
are passed within four weeks as directed
above, the suspension shall
automatically come to an end but
without prejudice to the other rights of
the respondents.”
The writ petition is disposed in similar
terms with similar observations and directions, the
time period to be computed from the date that the
petitioner submits a copy of the present order.
The application stands disposed.
