BACKGROUND
The appellant Shri S.K.Nagarwal of Jaipur Vide his RTI application dated
19/8/2008 has sought information spreadover 24 Questions regarding corruption
in Eklakhi- Balurghat new BG line project of N.F Railway .
2. PIO vide his letter dt. 29/09/08 gave reply to queries of the Appellant . The PIO’s
decision was challenged and an appeal was made before the FAA on
24.10.08.Not having received any decision from FAA , the Appellant filed the
second appeal on 26.12.08.
3. The Bench of Mrs. Omita Paul, Information Commissioner, heard the matter on
17th June,2009.
4. Shri Sanjay Goel, DV(M), Shri R.K.Shekhawat, DVE-I, Shri J.S.Sehrawat, S.O
and Rakesh Kumar, S.O./RTI represented the respondent.
5. Mr. Mahendra Singh , representative of the Appellant was present
DECISION
The Commission heard both the parties. The appellant stated that his letters
were sent to various offices leading to the leakage of information to the contractors,
which lead to a threat to his life. The appellant had to approach Honorable High Court,
Guwahati to provide security to the petitioner round the clock. The Commission directed
the Nodal officer to ensure that the references sent by the RTI Cell to Railways were
properly handled and acted upon by the North Western Railway. The Commission made
the nodal officer responsible for ensuring compliance. As far as the complaint received in
2007 was concerned, the respondent submitted that the investigations have been
completed. The Commission directed the nodal officer to furnish this information to the
Appellant without any delay. Regarding para 11, the Respondent was directed to give
the details regarding the Registration No. and case file no. to the Appellant while rest of
the information need not to be disclosed till the investigation is over.
Regarding two other vigilance cases mentioned in para 12, the Resopondent
submitted that the investigation had been completed. The Respondent was directed to
provide the information on the completed cases on para 8,9 &14 .The Commission
upheld the views expressed by the Respondent in their letter dated 22/9/2008. The
Commission further directed the Respondent to provide information sought by the
Appellant in para 15. All the information should be provided by the Respondent to the
Appellant within 2 weeks under intimation to the Commission.
