In this writ petition, the petitioner has prayed for a direction on the
respondents to issue order of approval of the petitioner’s appointment, which is
pending before the respondent no.2 since 23.2.2010.

It has been stated that the petitioner was appointed as Assistant Teacher
in Primary School, Korya Mission, Dumka. The School is a minority School and
the petitioner was appointed by the Managing Committee of the School on
3.10.2009. She joined as Teacher in the said School on 23.2.2010. The
petitioner’s appointment was sent for approval to the concerned authority, but
the respondents have not approved the petitioner’s appointment.

Learned J.C. to G.P.III, appearing on behalf of the respondents,
submitted that the District Superintendent of Education, Dumka-respondent no.3
is the competent authority to consider the petitioner’s claim and if the petitioner
files representation before the said respondent, he shall consider the same and
pass appropriate order.

Considering the said submissions, this writ petition is disposed of giving
liberty to the petitioner to raise his grievance by filing representation before the
District Superintendent of Education, Dumka-respondent no.3 and if the matter
is still pending for disposal before the said respondent, he shall take a decision
immediately and issue appropriate order in accordance with law, within two
months from the date of receipt of representation.
