Heard learned counsel for the applicant, learned A.G.A. for the State and
perused the record.
Learned counsel for the applicant has contended that the applicant has been
falsely implicated in this case and co-accused Milap Singh has been allowed
bail by this court. The applicant is in jail since 22.4.2010.
Learned A.G.A. has contended that the applicant himself had got the FIR
lodged and his wife Mithlesh has given statement to this effect. It is further
contended that the applicant has criminal history of 3 cases.
The applicant himself has got the FIR lodged against 3 accused persons,
thereafter the applicant has been implicated as an accused. Wife of the
applicant Mithlesh has given statement that she had not seen the occurrence
and also could not disclose the name of the assailants. Co-accused has been
allowed bail by this court.
Considering the nature of accusation and the severity of punishment in case of
conviction and the nature of supporting evidence, reasonable apprehension of
tampering of the witnesses and prima facie satisfaction of the court in support
of the charge, the applicant is entitled to be released on bail.
Let the applicant Munna Lal alias Brijesh involved in case crime no. 149 of
2010, under section 302, 120B IPC, P.S. Jaswantnagar, District Etawah be
released on bail on his furnishing a personal bond with two sureties each in
the like amount to the satisfaction of the court concerned.
