                            JUDGMENT

The petitioner was proceeded against by the 5th respondent

for amounts due under the Kerala Panchayati Raj Act. The

petitioner filed a suit challenging the same, inter alia, on the

ground of limitation, the same was dismissed in view of

amendment to Section 72, whereby the jurisdiction of the Civil

Court was taken away and instead a right of taking up the matter

with the Board of Revenue was incorporated. The petitioner now

submits that he has filed Ext.P10 before the Commissioner of

Land Revenue, who exercises functions of the Board of Revenue

after abolition of the Board of Revenue. The petitioner seeks a

direction to the 1st respondent to consider and pass orders on

Ext.P10 expeditiously.

2. I have heard the learned Government Pleader also.

In the facts and circumstances of the case, I dispose of this

writ petition with a direction to the 1st respondent to consider and

pass orders on Ext.P10 as expeditiously as possible, at any rate,

within a period of three months from the date of receipt of a

copy of this judgment, after affording an opportunity of being

heard to the petitioner. Till orders are so passed, the interim

stay granted by this Court shall continue to be in force,

provided the petitioner has remitted an amount of Rs.25,000/-

as directed by order dated, 24.3.2008. The petitioner shall

forward a certified copy of this judgment along with a copy of

the writ petition to the 1st respondent for compliance.
